Service Agreement

1. Introduction

1.1. This Service Agreement ("Agreement") governs the purchase and delivery of personalized children's stories created using artificial intelligence through the Skazka.ai platform (the "Service").

1.2. The Service is provided by LLC EVALLUME ("Provider," "we," "us"): 30 N Gould St Ste N, Sheridan, WY 82801, United States. Email: support.us@skazka.ai.

1.3. The Customer ("you") is an individual at least 18 years old who places an order on skazka.ai. By ordering for a child, you represent that you are the child's parent or legal guardian.

1.4. By completing a purchase you accept this Agreement, the Terms of Service, the Privacy Policy, and the Cookie Policy; when ordering voice narration in your own voice, you also accept the Biometric Data Consent. The current version and its date are shown on the Site. Changes are not retroactive and do not affect orders already paid (see §16).

2. Definitions

Service — the skazka.ai platform and its features. Content — the story text and illustrations. User Materials — data, photo, and voice sample you provide. Preview — the free pre-purchase preview. Final Approval — approval of the layout before printing. Avatar — a stylized AI depiction created from a photo.

3. Services Offered

3.1. We provide access to the Service to create a personalized children's story using artificial intelligence. Depending on the tier selected on the Site, the Service includes: AI-generated story text; AI-generated personalized illustrations; delivery digitally (online access and/or PDF) and/or as a printed book; and, optionally, audio narration by a synthetic voice (Audio AI) or in your own voice using voice-cloning technology (Audio Clone). Tier contents and prices are as stated on the Site at the time of order.

3.2. Nature of the Service and user control. The Service provides tools for you to independently create and edit your story. You independently: supply the input data; select an illustration style from those offered; edit the text in the editor without limitation prior to finalizing the result; and regenerate illustrations within the limits stated on the Site for your tier. The final result is produced on the basis of your choices and decisions. We supply the functional capability, not a warranty of any specific artistic or literary outcome, which depends on your inputs and decisions.

4. Personalization and User Materials

4.1. Personalization is based on data you provide: the child's first name, age range, gender, interests, eye color, a photo (to create the Avatar), an optional dedication, and — for Audio Clone — a sample of your voice.

4.2. Biometric processing. The original photo is deleted immediately after the Avatar is created and is not retained. For Audio Clone, the voice sample and voice model are processed ephemerally and deleted after the narration is produced. The photo and voice sample are biometric data, processed only on the basis of your separate explicit consent (Biometric Data Consent), solely to provide the Service. A child's voice is never cloned: Audio Clone is available only for the adult Customer's voice.

4.3. You warrant that you hold the rights to the User Materials you provide and are entitled to submit them, including that you are the parent or legal guardian of the child whose data and photo you upload.

5. Preview and Nature of AI Content

5.1. Before payment we provide a free Preview to assess quality and style, with a choice of several illustration styles (the current number is shown on the Site). Additional styles and regenerations may be available for a fee as stated on the Site.

5.2. Nature of AI content. Content is created using generative AI; results are variable and probabilistic. The Avatar is a stylized artistic depiction inspired by a photo, not a portrait or a biometrically accurate image of the child. A result's failure to match your subjective expectations, where the Service is of adequate quality, is not a defect. We make reasonable efforts to filter undesirable content but do not warrant that AI generation is entirely error-free. Our use of AI is disclosed (see AI Disclosure).

6. Pricing and Payment

6.1. Prices are as stated on the Site at the time of order, in US Dollars (USD). Applicable sales tax or VAT is calculated and displayed at checkout before you pay.

6.2. Shipping cost for printed books is not included in the price (see §7).

6.3. Merchant of Record. Online, Digital, and Audio purchases are processed by Lemon Squeezy, our Merchant of Record and the seller of record for those transactions; Lemon Squeezy handles payment processing and sales-tax/VAT compliance, and your statement will show "Lemon Squeezy" or "LMSQUEEZY." By purchasing, you also agree to Lemon Squeezy's Terms. Printed books are processed through Stripe, and for those purchases LLC EVALLUME is the seller of record. Payment is complete upon confirmation from the respective processor.

6.4. We may change prices at any time; changes do not affect orders already placed.

7. Delivery and Shipping (printed books)

7.1. Shipping cost is not included in the price unless the Site expressly states otherwise (e.g., a "free shipping" promotion). It is calculated separately based on the address, dimensions, and carrier rate, and shown to you before payment is completed. We ship internationally where the Site allows selection of your country.

7.2. Delivery times are estimates and depend on the carrier and region; they may increase during holidays and force majeure. Risk of loss or damage passes to you upon hand-over of the copy to the carrier.

7.3. You are responsible for address accuracy; we are not liable for delays or non-delivery due to an incorrect address. For international shipments, import duties, taxes, and customs fees of the destination country are paid by the recipient, unless stated otherwise.

8. Fulfilment, Editing, and Final Approval

8.1. Estimated timelines: Preview — a few minutes; digital version — as stated on the Site (approx. 30–40 minutes after payment); printed book — generation plus production and shipping as stated on the Site. Technical issues or high load may extend timelines, with notice.

8.2. Editing. Until you finalize/submit the result, you may edit the text and regenerate illustrations within your tier.

8.3. Final approval before printing. A printed book is manufactured from the layout you create and review yourself. Pressing "Send to print" constitutes final approval of the layout (proof approval): you confirm that you have reviewed and approved all content — spelling, names, dates, facts, selected illustrations and cover — and authorize manufacture in exactly that form. After final approval, editing becomes technically unavailable and production and shipment begin automatically.

8.4. We bear no liability and provide no refund or free reprint for errors, typos, inaccuracies, or illustration choices contained in the layout you approved, because you had a full opportunity to detect and correct them before approval. We are responsible solely for conformity of the manufactured copy to the approved layout and for the absence of manufacturing defects.

9. Refund Policy

9.1. A refund is provided: (1) before the Service begins (before full-version generation starts) — on request, less actually incurred costs where applicable; (2) for technical failure attributable to us that prevents creation of the result — full refund or free re-generation at your choice; (3) for a manufacturing defect of a printed copy (print defect, shipping damage, non-conformity to the approved layout) — free replacement or full refund.

9.2. A refund is not provided, in particular: after successful delivery of a digital result of adequate quality; for subjective reasons (dislike of plot, style, or degree of avatar likeness); due to the quality of input data you supplied (e.g., a blurry photo); for errors in a layout you approved before printing (§8); or after manufacturing has begun, except for manufacturing defects. Payment-processing fees are non-refundable.

9.3. To request a refund, contact support.us@skazka.ai with your order number and reason. Requests are reviewed within 2 business days; approved refunds are processed within 5–10 business days to the original payment method (via Lemon Squeezy where applicable).

9.4. EU/EEA and UK consumers: statutory withdrawal rights and their exceptions (personalized goods; digital content begun with your consent) are set out in the EU/UK Consumer Rights & Withdrawal document, which prevails for such consumers. Nothing here limits non-waivable consumer rights.

10. Intellectual Property

10.1. Exclusive rights to the created Content belong to LLC EVALLUME. Upon payment you receive a non-exclusive, royalty-free, non-transferable license to use the story for personal, family, non-commercial purposes: reading, printing copies for personal use, making backups, and posting on personal social-media accounts without a profit motive.

10.2. You may not sell, license, or commercially distribute the Content or its elements; transfer rights to third parties; or claim authorship of the AI content.

10.3. You grant us a limited license to use your User Materials solely to provide the Service. We may use anonymized examples (without names, photos, or voice) in marketing.

11. Your Rights and Obligations

11.1. You have the right to: receive a free Preview; edit text and regenerate illustrations within your tier; receive your purchased result in the selected format; request a refund under §9; and contact support.

11.2. You agree to: provide accurate information and warrant your rights to it; review the content and approve the layout before printing; not use the Content commercially without permission; maintain the confidentiality of your account; and review the Preview before purchasing.

12. Our Rights and Obligations

12.1. We will: deliver the Service as described; protect your and your child's data per the Privacy Policy; delete the original photo after Avatar creation and process voice ephemerally; provide support; and process refunds per §9.

12.2. We may: engage third-party subprocessors to perform the Service; refuse service with a full refund; suspend accounts that violate the Terms; use anonymized examples in marketing; and delete an unpaid Preview after the period stated on the Site (the avatar and child's data remain in the account).

13. Disclaimers and Limitation of Liability

13.1. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

13.2. Our aggregate liability for any claim related to the Service is limited to the amount you paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, punitive, or consequential damages. These limitations apply to the maximum extent permitted by applicable law and do not exclude liability that cannot be excluded (including for manufacturing defects and for harm caused intentionally or by gross negligence).

14. Children's Privacy (COPPA) and Data

14.1. The Service is intended for adults to create stories for children; children under 13 may not use it directly. We collect a child's information only from the parent/guardian. Data processing is governed by the Privacy Policy; biometric data (photo, voice) by the Biometric Data Consent.

15. Governing Law and Disputes

15.1. This Agreement is governed by the laws of the State of Wyoming, USA, except that nothing in this Agreement deprives a consumer of the protection of the mandatory provisions of the law of the country in which the consumer resides. Before any formal claim, the parties will attempt informal resolution (response within 30 days). EU/EEA and UK consumers retain the rights in the EU/UK Consumer Rights & Withdrawal document and may use their local courts and any available ODR/ADR mechanisms.

16. Changes and Versioning

16.1. We may modify this Agreement. A new version takes effect upon posting on the Site with its number and date, is not retroactive, and does not affect orders already paid. Version history is retained; the version you accepted is recorded at checkout.
