1. Agreement to Terms

1.1. These Terms of Service ("Terms") are a binding agreement between you and LLC EVALLUME ("Company," "we," "us"), governing your use of the Skazka.ai website and services (the "Service"). LLC EVALLUME, 30 N Gould St Ste N, Sheridan, WY 82801, USA; support.us@skazka.ai.

1.2. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Commercial terms (price, payment, delivery, refunds) are governed by the Service Agreement; data processing by the Privacy Policy, Cookie Policy, and Biometric Data Consent.

2. Eligibility

2.1. You must be at least 18 years old to use the Service and represent that you are.

2.2. The Service is designed for parents and legal guardians to create stories for children. By uploading a child's information, you represent that you are the child's parent or legal guardian and are authorized to provide it.

2.3. COPPA. Children under 13 may not use the Service directly. All information about children must be provided by a parent or legal guardian in compliance with the Children's Online Privacy Protection Act.

3. Description of the Service

3.1. Skazka.ai creates personalized children's stories using artificial intelligence, in Online, Digital (PDF), and printed-book formats; optionally with audio narration by a synthetic voice (Audio AI) or in the adult user's own voice using voice cloning (Audio Clone). Tier contents and numeric parameters (styles, regenerations, timelines) are as stated on the Site.

3.2. Nature of the Service and user control. The Service provides tools for you to independently create and edit your story: you supply the inputs, select an illustration style, edit the text without limitation before finalizing, and regenerate illustrations within your tier's limits. The final result is produced on the basis of your choices. We supply the functional capability, not a warranty of any specific artistic or literary outcome.

4. Account Registration

4.1. You must create an account with a valid email address, provide accurate information, keep your credentials confidential, are responsible for activity under your account, and must notify us of any unauthorized use.

5. Acceptable Use

5.1. Permitted: creating personalized stories for your children for personal, non-commercial use; uploading children's photos with your consent as parent/guardian; sharing stories within your family.

5.2. Prohibited: uploading children's photos without parental/guardian consent; uploading illegal, harmful, defamatory, or obscene content or content promoting violence; commercial use without written permission; reverse engineering, hacking, or disrupting the Service; automated access (bots, scrapers); infringing others' rights.

5.3. We may suspend or terminate accounts for violations without prior notice.

6. Content and User Responsibility

6.1. Review and approval of content. You review your generated content and are responsible for its final version. For printed orders, pressing "Send to print" constitutes final approval of the layout: you confirm you have reviewed spelling, names, facts, and selected illustrations, after which editing becomes unavailable. You are responsible for errors in a layout you approved; details are in the Service Agreement.

6.2. Nature of AI content. Content is created using generative AI; results are variable and probabilistic. The Avatar is a stylized artistic depiction, not a portrait or biometrically accurate image. A result's failure to match your subjective expectations, where the Service is of adequate quality, is not a defect. We make reasonable efforts to filter undesirable content but do not warrant AI generation is error-free.

7. Payments and Billing

7.1. Price, payment, delivery, and refunds are governed by the Service Agreement. In summary: the free Preview is provided before payment; the full version is created after payment; prices are in USD; applicable tax is shown at checkout; shipping for printed books is charged separately; payments are processed by Lemon Squeezy (Merchant of Record) or, for printed books, Stripe.

8. Intellectual Property

8.1. The Service — its design, logo, software, and content (excluding user-generated content) — is owned by LLC EVALLUME and protected by intellectual-property laws.

8.2. License to created stories. Upon payment you receive a non-exclusive, royalty-free, non-transferable license to use the story for personal, non-commercial purposes (reading, printing for personal use, sharing on personal social media without a profit motive). You may not sell, license, redistribute, or claim authorship of the AI content.

8.3. Your content. You retain ownership of the materials you provide and grant us a limited license to use them solely to provide the Service.

9. Privacy

9.1. Your use of the Service is also governed by the Privacy Policy, Cookie Policy, and, for biometric data, the Biometric Data Consent, including provisions on children's data (COPPA), the immediate deletion of photos after Avatar creation, and ephemeral voice processing.

10. Disclaimers

10.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

10.2. We do not guarantee the Service will be uninterrupted, secure, or error-free, and may modify, suspend, or discontinue it at any time.

11. Limitation of Liability

11.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LLC EVALLUME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. These limitations do not exclude liability that cannot be excluded by law (including manufacturing defects and harm caused intentionally or by gross negligence).

12. Indemnification

12.1. You agree to indemnify and hold harmless LLC EVALLUME and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms or of any third-party rights, or content you upload.

13. Dispute Resolution and Governing Law

13.1. Before any formal claim, you agree to contact us at support.us@skazka.ai to attempt informal resolution (response within 30 days).

13.2. These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law provisions, except that nothing herein deprives a consumer of the protection of the mandatory provisions of the law of the country in which the consumer resides. EU/EEA and UK consumers retain the rights in the EU/UK Consumer Rights & Withdrawal document and may use local courts and available ODR/ADR mechanisms.

14. Changes to Terms

14.1. We may modify these Terms. We will post the updated Terms with their version number and date. Your continued use after changes constitutes acceptance of the modified Terms. Version history is retained.

15. Termination

15.1. We may suspend or terminate your account at our discretion for conduct we believe violates these Terms or harms others. You may terminate your account at any time by contacting support.us@skazka.ai. Provisions that by their nature should survive termination shall survive.

16. Miscellaneous

16.1. Entire Agreement: these Terms, the Service Agreement, and the referenced policies constitute the entire agreement regarding the Service. Severability: if any provision is invalid, the remainder stays in effect. Waiver: failure to enforce a provision is not a waiver. Assignment: you may not assign these Terms without our consent; we may assign them without restriction.
